Create An Ad - Terms & Conditions
Orders for advertisements are accepted by the the publisher on the following conditions:-
1. The advertiser warrants that in relation to each advertisement placed for publication with the Publisher (whether or not amended pursuant to clause 3):
The reproduction and/or publication of such advertisement will not breach any contract or infringe or violate any copyright, trademark, or any other personal or proprietary right of any person or render the Publisher liable to any proceedings whatsoever;
In relation to any investment advertisement, the advertiser is, or the contents of the advertisement have been approved by, an Authorised Person within the meaning of the Financial Services Act 1986 as amended, or the advertisement is otherwise permitted under that Act as amended;
The advertisement complies with the requirements of all relevant legislation (including subordinate legislation, the rules of statutory regulatory authorities, and the law of the European Community) for the time being in force in the United Kingdom;
All the advertisements submitted to the Publisher are legal, decent, honest and truthful, and comply with the British Code of Advertising Practice and all other relevant codes under the general supervision of the Advertising Authority.
2. Although the Publisher takes every precaution to ensure that all advertisements appear correctly it is the responsibility of the advertiser to check advertisements and notify the Publisher of any mistake or inaccuracy immediately it appears. However the Publisher will make every effort to ensure accuracy at all times.
3. Liability in accordance with clause 4 below will only be accepted for the first insertion of an advertisement in a series of advertisements.
4. In the event of any colour blurring, colour changes or lack of colour registration, and in the event of any error, misprint or omission in the printing of an advertisement or part of an advertisement, the Publisher will either re-insert the advertisement or relevant part or parts of the advertisement as the case may be or make a reasonable refund of or adjustment to the cost. No re-insertion, refund of or adjustment to will be made where the colour error, misprint or omission does not materially detract from the advertisement. In any event, the publisher's total liability for any error, misprint or omission shall not exceed the smaller of the following:
(i) the amount of a full refund of any sum paid to the Publisher for the advertisement in connection with which the liability arose; or
(ii) the cost of a further or corrective advertisement of a type and standard reasonably comparable to that in connection with which liability arose.
5. The Publisher will not be liable for any loss of copy, artwork, photographs or other materials howsoever caused. Advertisers providing such materials warrant that they have retained the same in sufficient quality and quantity for whatever purpose.
6. In all colour publications there may be a small amount of drifting where the two colours, which are required to make a third colour, do not entirely match. This gives the impression of a shadow on the text and cannot be avoided. The Publisher will not be liable for breach of contract where this blurring occurs. Colour registration will conform to the current IFRA print specifications.
7. The Publisher reserves the right to make such alteration to or abbreviations in the advertisement as it sees fit.
8. The use of Box Numbers is confined to private advertisers only (except Situations Vacant). The Publisher does not accept liability for (a) any loss or delay in the receipt by the advertiser of replies to Box Numbers; (b) any disclosure of the identity of the advertiser to any third party.
9. The Publisher's agreement to publish the advertisement is conditional upon the Publisher seeing the proposed advertisement. The Publisher reserves the right to refuse part or all of the advertiser's artwork or copy for whatever reason in its sole discretion.
10. If the Publisher is required by the Trading Standards, Police or any other similar person or body to disclose information relating to any such advertisement, the advertiser authorises the disclosure of such information and acknowledges that the Publisher is acting in good faith and acknowledges that it has no right or cause of action in respect of that disclosure.
11. The advertiser acknowledges that neither the Publisher nor any person purporting to act on behalf of the Publisher has made any offer (a) to supply advertising space to the advertiser on the condition or understanding that the advertiser does not acquire or offer to acquire advertising space in a publication produced by any other person; (b) to treat the advertiser more favourably if it does not do so or less favourably if it does so.
12. The following provisions apply to casual advertisers (i.e. those without monthly accounts): All private advertising including death notices must be prepaid. All trade advertising with an invoice address outside the county boundaries of Gloucestershire must be prepaid. All trade advertising for less than £50.00 including VAT or more than £250.00 including VAT must be prepaid. Credit accounts are available, subject to status, to trade advertisers who do not have monthly accounts.
Credit Terms - All advertisements placed on behalf of customers who do not have approved credit account facilities will be invoiced at a rate 50% higher than the published advertising rates for account customers. The additional charge is waived if payment is received within 10 days of the invoice date. For the purposes of deciding whether or not to accept applications for credit account facilities, the Publisher may make an application to a credit reference agency for information relating to creditworthiness. The advertiser should note that if the Publisher does this a note may be made on the advertisers' credit file held by that credit reference agency to the effect that a check has been made by the Publisher.
13. The placing of an order by the advertiser is deemed to be an acceptance of these conditions.
14. These Conditions shall be interpreted in accordance with and governed by English law.
COPYRIGHT
In consideration of the Publisher publishing the advertisements herein, the advertiser(s) confirms that copyright and any other intellectual property rights in the advertisements shall be vested in and be the sole property of the Publisher, who alone shall have the right to bring proceedings and to claim damages and all other relief in respect of all the infringements of the said copyright and other intellectual property rights.
